Terms and Conditions

These Terms and Conditions ("Terms") govern your use of SLA Guard, a service operated by Studio Monstera Inc. ("we", "us", or "our"). By accessing or using SLA Guard, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

SLA Guard is a monitoring service that automatically checks the New York State Liquor Authority (NYSLA) Cash on Delivery (C.O.D.) list for your liquor license(s) and sends you SMS and/or email alerts when your status changes. We do not guarantee 100% accuracy or timeliness of the data, as it depends on the official NYSLA database and third-party delivery services.

2. Subscriptions and Billing

The Service is offered on a recurring monthly subscription basis. Pricing is $4.99 per license per month, with volume discounts available for multiple licenses. Payments are processed securely via Stripe. Subscriptions automatically renew each month until cancelled. You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period.

3. User Responsibilities

You represent and warrant that: You are at least 18 years old and authorized to act on behalf of the business associated with the liquor license(s). All information you provide (including business name and license serial numbers) is accurate and complete. You will only use the Service for legitimate business purposes.

4. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your information. We use third-party services (Stripe for payments, Twilio/Telnyx for SMS, and Google services for automation) to deliver the Service.

5. Limitations and Disclaimers

SLA Guard is provided "as is" without warranties of any kind. We are not responsible for delays, failures, or inaccuracies caused by the NYSLA, third-party providers, or internet issues. We are not liable for any business losses, missed deliveries, or damages resulting from your use (or inability to use) the Service.

6. Limitation of Liability

To the fullest extent permitted by law, our total liability to you shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.

7. Termination

We may suspend or terminate your access to the Service at any time for any reason. You may cancel your subscription at any time through your Stripe account or by contacting us.

8. Governing Law

These Terms are governed by the laws of the State of New York. Any disputes shall be resolved exclusively in the courts located in New York County, New York.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of SLA Guard after such changes constitutes acceptance of the new Terms.
